Ministerial Conditions

On 23 February 2011 the Minister for Environment imposed Interim Implementation Conditions on Magellan Metals under Section 46A of the Environmental Protection Act 1986, relating to the mining, concentrating, packaging and transportation processes at its Wiluna mine site and to, and through, the Port of Fremantle.

Magellan Metals has accepted these new conditions, which are particularly focused on clarifying roles, responsibilities and timelines relating to the reporting of auditing and monitoring results in connection with its transport operation.

The new Interim Implementation Conditions supersede all earlier Ministerial conditions previously imposed on the company.

The Interim Implementation Conditions were issued pending a full inquiry by the Environmental Protection Authority (EPA) into the original and interim conditions; this is now complete. The EPA released the Section 46 Report on Monday 3 October 2011.

The Report provides the EPA’s recommendations on the Draft Operating Conditions for the Minister’s consideration. The Minister will consider the Report and decide on the final content of the operating conditions.

It should be noted that whilst the Draft Operating Conditions are under consideration the Interim Implementation Conditions remain in place.
